TERMS & CONDITIONS - WHOLESALE


The Seller carries on the business of the wholesaler supply and distribution of various types of jewellery (the “Product”) including associated display, packaging and presentation materials for such jewellery, and the Buyer wishes to purchase the Seller’s Product from the Seller.

The Seller and Buyer acknowledge and agree that the Buyer may from time to time request the Seller to sell the Product to the Buyer and that the Seller has complete discretion as to whether it chooses to sell the Product to the Buyer and is under no obligation to do so.

Payment


All payments by the Buyer to the Seller are to be made by cash, on-line transfer, credit card or EFTPOS. No delivery shall be made and no property passes in the Product until full payment is received by the Seller unless approval has been given by JQ Jewellery in writing.

All costs, fees and charges associated with shipping or delivery of the Product shall be borne by the Buyer.

Shipping


All purchases are to be paid for prior to shipping. Any retailer wishing to discuss their needs can contact us to organise a time to call. Jacquie is more than happy to assist with your selection however any advice given is merely suggestions and the purchaser takes full responsibility for any choices made in terms of stock selection.

JQ Jewellery is not responsible for any delays or items which have gone missing in the post whilst being sent to you. All items will be sent by registered post with either Australia Post or a courier company. If your order does not arrive, please contact us and we can provide you with the shipping details so you can follow it up.

Packaging


All wholesale purchases will be packaged together. No inidivudal items will be gift wrapped or placed in gift boxes.

Gift Vouchers


Gift Vouchers cannot be utilised when making wholesale purchases.

Responsibilities of Buyer


The Seller and the Buyer acknowledge and agree that the Buyer will comply with all relevant statutes, regulations, by-laws, ordinances, requisitions and other laws in force and indemnify the Seller against any losses liabilities costs or expenses incurred by the Seller as a result of the Buyer’s failure to comply with such laws and obligations.

The Seller is not responsible for, and the Buyer or the Buyer’s employees servants or agents and shall not have any claim against the Seller for, annual leave, sick leave, long service leave, public holidays, superannuation contributions, redundancy payments or any other similar benefits nor for any costs or expenses incurred by the Buyer of whatsoever nature and which relate to its own business or operations.

The Buyer must not be a party to the doing of any act, matter or thing whereby the goodwill, commercial reputation and overall public image of the Seller is or may be prejudicially affected.

The Buyer must be aware that it is not the responsibility of the seller if the stock purchased does not sell once in the Buyer's possession.

30 Day Return Policy


All jewellery which is returned within the 30 day warranty period must be returned undamaged and in it's original packaging. A copy of the receipt must be provided as proof of purchase. Please email Jacquie to advise the reason for returning the goods and we can advise you when we receive the parcel.

The jewellery must be received back at this office in it's original condition and must not have been worn, altered or damaged in any way. Earrings and hairclips cannot be returned because of issues with hygiene.

It is the responsibility of the sender to ensure the jewellery arrives at our office. Please take all necessary steps to ensure it is appropriately packed and tracked as we cannot be responsibile for jewellery which is not received.

JQ Jewellery is not liable for the postal costs of returning the goods.

The cost of the item (less the postage) will be refunded to the credit card on which it was purchased or other method depending on payment. In the event that more than one item is returned, then the refund will be dependent on the total number of items, cost and what percentage was applied to the original order. In the event that the number of items returned reduces the overall cost of the original order, the total refund will be adjusted accordingly based on the percentage discount and the relevant refund will be applied.

Faulty Goods - 6 Month Warranty


JQ Jewellery warrants that for a period of six (6) months from the date of the sale or supply of the Product, they will provide refunds or replace Products that are not of merchantable quality or not fit for their purpose but shall not replace any Product that is broken, faulty or damaged due to the Product being treated or handled in other than a reasonable manner or provided that the same is not due to the abuse, negligence or neglect of the Buyer or a third party.

A copy of the receipt must be provided as proof of purchase. Please contact us to advise what the issue is prior to posting to ensure you are covered under the warranty.

If the product is covered by the warranty conditions, a full refund will be given for the purchase price together with the cost of return postage and will be refunded back to the credit card used for the purchase. In the event that another form of payment was used, a cheque will be sent out. Please note that we will not cover the cost of the initial postage to you.

Diamonte stones which have come loose will only be covered in the event that they are damaged whilst being posted and must be returned complete with loose stone and copy of your receipt. No other loss of diamontes will be covered under this warranty.

JQ Jewellery is not liable for any infection or injury caused by the wearing of any of our products.

Jewellery is not recommended use by Children under the age of 3 years.

Conditions of sale



The Buyer acknowledges and agrees that all purchases made through this website are on a discounted scale (inclusive of GST) Any further purchases thereafter of the Product shall be under the same conditions. The discounts on levels of purchase will be emailed upon request.

Subject to its absolute discretion, the Seller will sell the Product to the Buyer at a price being her Recommended List Price as published or stated by the Seller from time to time minus the relevant discount.

Insurance


The Buyer must effect maintain and keep current policies of insurance with a reputable insurance company insuring the Buyer and the Buyer’s employees agents servants and subcontractors against any liability arising by virtue of statute or common law in respect of the death or personal injury to any person or damage to any property arising out of or in the course of the purchase of the Product from the Seller or the on-sale of the Product.

In the event that the Buyer has no insurance coverage JQ Jewellery accepts no responsibility for insuring the Buyer and the Buyer’s employees agents servants and subcontractors against any liability arising by virtue of statute or common law in respect of the death or personal injury to any person or damage to any property arising out of or in the course of the purchase of the Product from the Seller or the on-sale of the Product.

Legal Relationship



The Seller and the Buyer acknowledge and agree that there is no legal relationship between them except for buyer and seller and not that of employer and employee. No terms shall be construed as creating a relationship of employer and employee between the Seller of the one part and the Buyer or any employee servant agent subcontractor or assignee of the Buyer of the other part. In addition, nothing in the purchase of the products shall constitute a partnership between the Seller and Buyer.

Without limiting the generality of the foregoing, all expenses incurred or accrued by the Buyer arising out of or related to in any way to the Buyer’s business is to be sole responsibility of the Buyer including but not limited to superannuation and worker’s compensation.

Confidential Information and other restrictions


Under no circumstances is the Buyer, except as authorised by the Seller, to reveal to any person company or firm any of the client lists, trades secrets, secrets or confidential operations, processes or dealings or any information concerning the Seller (“Confidential Information”) which may come to the Buyer’s knowledge and the Buyer must keep completely secret during and after the Term the Confidential Information entrusted to the Buyer and shall not use or attempt to use the Confidential Information in any manner which may injure or cause loss either directly or indirectly to the Seller or its businesses, or may be likely to do so.

Other Terms & Conditions


In addition to the Terms & Conditions outlined here, the buyer also agrees to purchase the goods on the basis of acceptance of any relevant General Information provided in this website.
